Dispute resolution
Before either party seeks arbitration, the party with the dispute must send the other party a written notice describing the nature of the dispute and the relief requested. If it is not resolved within thirty (30) days, either party may start an arbitration proceeding.
The arbitration will be conducted by a single, neutral arbitrator. Any hearing will be held in Omaha, Nebraska unless both parties agree otherwise. Each party will bear its own costs (including attorney’s fees) and will pay an equal share of the arbitrator fees. The arbitration may be conducted by phone, online, by written submissions, or by personal appearance as agreed to by the parties.
Both parties hereby waive their constitutional rights to go to court and have a trial, whether in front of a judge or a jury. All disputes will be resolved by arbitration. All disputes will be arbitrated on an individual basis and not on a class basis. Each dispute will be arbitrated individually, without respect to any other matters, disputes, or additional parties.
